Welcome to JIVN (https://jivn.in ), operated by M/s Mahabir Stores, a proprietorship firm registered in Kolkata, West Bengal, India. By accessing our website, registering as a Trade Partner, or placing a wholesale order, you agree to be bound by these Terms of Service. Please read them carefully.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you (the "User", "Buyer", or "Trade Partner") and M/s Mahabir Stores ("we", "us", or "our"). By using this website or purchasing our products (wholesale spices, dry fruits, makhana, sugar, pulses, and grocery items), you confirm that you have read, understood, and agreed to these Terms.
If you do not agree with any part of these Terms, you must not use our website or services.
2. Business-to-Business (B2B) Nature
Our website and services are primarily designed for wholesale, B2B transactions. By registering or placing an order, you represent and warrant that:
•You are purchasing goods for resale, commercial, or institutional use.
•You have the legal capacity to enter into a binding contract on behalf of your business entity.
•The information provided during registration (including Business Name, GSTIN, and contact details) is accurate and current.
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, especially if we determine that an order does not meet our wholesale criteria.
3. Product Information and Pricing
Product Descriptions: We make every effort to display our products, including their quality, grades, and specifications, as accurately as possible. However, due to the agricultural and natural origin of our products (such as spices and dry fruits), slight variations in colour, size, and aroma may occur between batches.
Pricing: All prices displayed on the website are wholesale rates and are subject to change without prior notice due to market fluctuations. The price applicable to your order will be the price confirmed in your Proforma Invoice at the time of order placement.
Taxes: Prices are exclusive of Goods and Services Tax (GST) and freight charges, unless otherwise explicitly stated. Applicable GST will be added to your final invoice.
4. Order and Payment Terms
Order Confirmation: An order placed on our website or via WhatsApp is considered an offer to purchase. The order is only confirmed when we issue a Proforma Invoice and verify product availability.
100% Advance Payment: We operate strictly on a 100% advance payment model. No credit terms or Cash on Delivery (COD) options are available.
Accepted Methods: Payments must be made via RTGS, NEFT, UPI, or IMPS to our verified bank account. The order will be locked and moved to dispatch only after the payment reflects in our account.
5. Shipping and Logistics
Transport Partners: We dispatch goods via third-party transport companies operating from Burrabazar, Kolkata. We do not use courier services for bulk orders.
Transfer of Risk: The risk of loss and title for the goods pass to you upon our delivery of the goods to the transport company and the generation of the transport receipt (Bilti/LR).
Freight Charges: All transport and freight charges are the responsibility of the Buyer and are payable on a "To-Pay" basis at the time of delivery, unless prepaid freight is agreed upon.
6. Limitation of Liability
To the maximum extent permitted by applicable Indian law, M/s Mahabir Stores shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of our website or the purchase of our products.
Our total liability for any claim arising out of or relating to these Terms or the products shall not exceed the total amount paid by you for the specific order giving rise to the claim.
7. Governing Law and Jurisdiction
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of India.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
8. Changes to Terms
We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
